Lawyers from Rio de Janeiro will ask the Court of Justice to create specialized courts in Real Estate Law. The objective is to make processes in the area faster and improve decisions. Lawyer Arnon Velmovitsky , partner at Velmovitsky Advogados Associados, states B2B Lead that several entities support the measure. Among them, the Real Estate Law commissions of the Rio branch of the OAB and the Institute of Brazilian Lawyers, the Brazilian Association of Real Estate Market Lawyers (Abami) and Secovi Rio, which represents real estate companies in the state. According to a survey coordinated by Velmovitsky, 21% of the lawsuits in Rio's courts deal with Real Estate Law. The diversity of laws on the subject makes the existence of specialized courts necessary, argues the lawyer. With in-depth knowledge of the subject, judges would make more well-founded decisions, reducing the rate of reversals in higher courts, he believes. Velmovitsky, who created the Real Estate Law commissions of the OAB of Rio and the IAB, also maintains that specialized judges would be faster. The lawyers' idea is that five of Rio's 52 civil courts be exclusively dedicated to real estate matters. This is to avoid creating expenses with the creation of the rods. Arnon Velmovitsky says that the group will look for the elected president of the TJ-RJ, judge Claudio de Mello Tavares, as soon as he takes office, in February 2019. The measure needs to be approved by the court's Special Body. If this occurs, the project is sent to the Legislative Assembly of the State of Rio de Janeiro, for conversion into law.
